What Causes an Underride Accident?
When a smaller vehicle crashes into a commercial truck and ends up under the trailer, it is called an underride accident. Since the majority of passenger vehicles are not short or small enough to fit under a trailer, underride accidents usually cause the top of the smaller vehicle to be sheared off. Catastrophic injuries or death are practically guaranteed in such a violent accident.
In many cases, underride accidents are caused by negligence on part of the truck driver and the parent trucking company. Big rigs have far more and far larger blind spots than smaller vehicles, who should do their best to stay out of these blind spots. An underride accident can occur when a truck driver fails to do due diligence in ensuring no smaller vehicles are in a blind spot before merging, changing lanes, or backing up.
Guardrails can be installed on trailers to stop underride accidents by effectively walling off the area underneath the trailer. Not all commercial trucks have guardrails installed, though, which is an inexcusable oversight by the trucking company that owns and maintains the tractor-trailer. Underride accidents have been a serious problem for decades, so all trucking companies should make a reasonable effort to install and maintain guardrails on their vehicles.
Injuries & Damages Suffered in an Underride Accident
As mentioned, underride accidents often result in catastrophic injuries. Smaller vehicles are not designed with many safety features that mitigate the damage and harm caused by the shearing effect of an underride accident.
Underride accident claims often seek damages for:
- Emergency medical bills
- Surgeries and extended hospitalization
- Rehabilitative therapy
- Lost wages
- Emotional trauma
- Vehicle repairs
If a loved one has lost their life in an underride accident, then additional and different damages will apply to your claim. For example, depending on the details of your case and the relationship you shared with the deceased, you could also receive noneconomic damages for your own loss of support and companionship.
